Dilapidations

'Dilapidations' refers to a state of disrepair in a property for which there is a legal responsibility to repair.

Whether you are a landlord or a tenant, you will probably have a lease which includes some repairing covenants.

At the start of a lease, it is a good idea to commission a 'Schedule of Condition'. This is used to provide evidence of the true condition of a property at the start of a new lease or the renewal of an existing lease.

During the lease, or at the end of it, a 'Schedule of Dilapidation' is undertaken to determine if the repairing covenants have been met. If they have not been met, the landlord's surveyor and the tenant's surveyor will need to work together to negotiate what work needs to be undertaken, or what compensation is due.
